Noncompetes are Here to Stay
The FTC’s ban on noncompete agreements has been…UPHELD!
ATS Tree Services, a small Philadelphia tree company challenged the ban…but Judge Kelly Hodge sided with the FTC’s initial ruling.
"The Court finds it clear that the FTC is empowered to make both procedural and substantive rules as is necessary to prevent unfair methods of competition," Hodge wrote. "Had Congress intended to limit the FTC's substantive rulemaking authority … it would have done so at any time over the last century."
The tree company argued that the ban was an overreach…and that they’d be irreparably harmed by the noncompete ban.
ATS also argued that employees would leave their company when the ban goes into effect.

The battle for tree labor in Pennsylvania must be intense!
ATS’ attorney, Josh Robbins refused to wave the white flag after the ruling…
"The FTC does not have the statutory authority to rewrite millions of employment contracts by banning noncompete agreements."
"Despite today's ruling, we will continue to fight the FTC's power-grab."
Around 30 million American workers are tied up by noncompetes.

Poor Workplace Treatment Due to Politics
What a political season it has been.
And with the election around the corner, it doesn’t appear that things will be slowing down.
Amidst the chaos, one thing has remained constant…
Poor workplace treatment due to political beliefs.
The Society for Human Resource Management conducted a survey of over 1,024 US workers. And they found that it has gotten so bad that more than half of surveyed workers have seen people treated poorly for their beliefs.
“After President Joe Biden and former President Donald Trump’s debate on June 27, 64% of US workers surveyed said they experienced or witnessed people being treated poorly in the workplace due to their political views.”
Roughly 25% of respondents expect the tension and conflict in the office to increase through the end of the year.
Folks, be nice to your coworkers and subordinates. Your peers are not your enemy.
